Terms and Conditions of Use

These Terms and Conditions of Use (hereinafter the "Terms") are intended to define and specify the terms of use of this website (hereinafter the "Site") as well as any associated services offered on it. These Terms apply to any person connecting to the Site (hereinafter the "User" or "Users") who, by the mere fact of accessing and consulting it, accepts them fully and irrevocably.

Access to the Neurocrypto.AI website is free. However, use of the NEMESIS AI bot requires a subscription according to the terms defined in the Terms and Conditions of Sale.

Access conditions:

• Be of legal age (minimum 18 years old) or have parental authorization
• Create a personal account with accurate and up-to-date information
• Have a functional Internet connection
• Use a compatible and up-to-date web browser

Neurocrypto.AI reserves the right to refuse access to the service, unilaterally and without prior notification, to any User who does not comply with these Terms.

NEMESIS AI is an artificial intelligence bot that analyzes:

• Global financial and economic news
• Political events likely to influence markets
• Cryptocurrency market trends
• Technical and fundamental indicators

Based on these analyses, NEMESIS AI provides predictions regarding potential cryptocurrency fluctuations.

To use NEMESIS AI, the User must have a personal account. There are three ways to create an account:

• Free account: Direct creation on the platform to benefit from 30 minutes of free trial
• Account reuse: If the PayPal email address matches that of the existing free account, the subscription will be automatically linked to that account
• Automatic creation: When making a PayPal payment, if no account exists with that email address, an account will be automatically created and a password will be generated and sent by email for access to NEMESIS AI

User obligations:

• Keep login credentials confidential
• Not share the account with third parties
• Immediately inform Neurocrypto.AI in case of unauthorized use of the account (within a maximum of 48 hours)
• Keep personal information up to date
• Secure computer equipment (computer, smartphone, tablet)
• Not write down login credentials in accessible places

The User is entirely responsible for all activity carried out via their account, including in case of fraudulent use resulting from lack of vigilance on their part.

Authorized uses:

• Personal and non-commercial use of the NEMESIS AI service
• Consultation of analyses and predictions for private use
• Interaction with the bot in compliance with these Terms

Prohibited uses:

• Resell NEMESIS AI analyses
• Use the service for illegal or fraudulent purposes
• Attempt to hack, decompile or reverse-engineer the system
• Overload servers with excessive requests (spam, automated bot)
• Create fake accounts or impersonate others
• Disseminate defamatory, offensive or illegal content via the service
• Commercially exploit analyses without prior written authorization

Any violation of these prohibitions will result in immediate suspension or termination of the account without refund and may be subject to civil and criminal prosecution.

Neurocrypto.AI strives to keep the service accessible 24/7. However, interruptions may occur for:

• Scheduled or emergency maintenance
• System updates and improvements
• Technical problems beyond our control
• Cases of force majeure

Force majeure: Neurocrypto.AI cannot be held responsible in case of events beyond its reasonable control, including:

• Massive cyberattacks, computer hacking, DDoS attacks
• Natural disasters (fire, flood, earthquake)
• Widespread failures of internet, electrical or third-party provider infrastructure
• Armed conflicts, riots, acts of terrorism
• Government or regulatory decisions requiring service suspension
• General strikes affecting essential services

Neurocrypto.AI cannot be held responsible for service interruptions, inability to access, indirect losses or service errors resulting from these events.

User responsibility:

The User acknowledges:

• Having taken note of the risks associated with cryptocurrency investments
• Using NEMESIS AI as a simple decision-making tool
• Being solely responsible for their investment decisions
• Not considering predictions as performance guarantees
• Having the financial capacity to bear potential losses
• Being responsible for all tax and legal consequences of their investments

General limitation: In any case, Neurocrypto.AI's liability is limited to the total amount paid by the User during the 12 months preceding the event giving rise to liability.

All elements of the Neurocrypto.AI website and the NEMESIS AI service are protected by intellectual property rights:

• The names "Neurocrypto" and "NEMESIS AI" are registered trademarks
• The artificial intelligence algorithms are proprietary
• The design, texts, images and content belong to Neurocrypto.AI
• The source code and technical architecture are confidential

Strict prohibitions:

• Reproduction, copying or extraction of source code
• Commercial exploitation of analyses or the service
• Redistribution or resale of generated content
• Reverse engineering or decompilation of the system

Any reproduction, representation, modification or unauthorized exploitation of these elements is strictly prohibited and constitutes counterfeiting sanctioned by law. Violations may result in civil (damages) and criminal prosecution.

Neurocrypto.AI is committed to protecting the personal data of its Users in accordance with the General Data Protection Regulation (GDPR) and applicable legislation.

Data collected:

• Identification data (name, surname, email)
• Connection data (logs, IP addresses, browsing history)
• Service usage data (requests, interactions)
• Payment data (securely processed by PayPal)

Retention period: Data is retained for the life of the account and up to 3 years after the last activity for legal and tax obligations.

Processing and security: Data is processed through secure service providers (hosting, payment via PayPal). Neurocrypto.AI implements all necessary technical and organizational measures to ensure data security.

Archiving is performed on a reliable and durable medium in accordance with applicable legislation.

Suspension by Neurocrypto.AI:

Neurocrypto.AI reserves the right to suspend or terminate an account in case of:

• Non-compliance with these Terms
• Fraudulent or abusive use of the service
• Attempt to hack or exploit vulnerabilities
• Harmful behavior towards other users
• Outstanding payments or payment fraud
• Violation of intellectual property rights

Suspension or termination for fault does not entitle to any refund of the current subscription.

Termination by the User:

The User can delete their account at any time by contacting support. The current subscription will not be refunded.

Neurocrypto.AI reserves the right to modify these Terms at any time. Users will be informed of significant changes by email or via a notification on the site.

The new Terms take effect upon publication on the site. Continued use of the service after modification constitutes acceptance of the new conditions.

If the User does not accept the new Terms, they must stop using the service and may request deletion of their account.

The Neurocrypto.AI website may contain links to third-party sites. Neurocrypto.AI exercises no control over these sites and disclaims all responsibility regarding their content, availability or personal data practices.

Access to these sites is at the User's own risk, who is solely responsible for their navigation on these third-party sites and the consequences that may result.

In case of dispute, the parties undertake to seek an amicable solution before any legal action.

The User may use free of charge the mediation service offered by Neurocrypto.AI or any consumer mediator to which it is subject.

The User may also submit their complaint on the European Commission's online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/

These Terms are governed by French law. Any dispute relating to the interpretation or execution thereof shall be submitted to the competent courts of Mulhouse, France.

Failing amicable resolution or mediation, the French courts shall have exclusive jurisdiction.

Neurocrypto.AI undertakes to respond within 24 to 48 business hours to any request for information or complaint.

If one or more provisions of these Terms are declared null or unenforceable, the other provisions shall retain their full force and scope.

The fact that Neurocrypto.AI does not invoke a User's breach of any of the obligations of these Terms cannot be interpreted as a waiver to invoke these provisions subsequently.

These Terms constitute the entire agreement between Neurocrypto.AI and the User regarding the use of the service.
